Every work you find here is an original, authored piece. There are no intermediaries, no gallery commissions, no anonymous sellers. You buy directly from me — and every purchased work comes with a certificate of authenticity.
Along with each painting, you receive its story: how it came to be, what I was thinking as I painted it, why that particular subject. If you’re curious, I can share it in a short message or a handwritten note enclosed with the work.

How It Works
Find a work that interests you and get in touch via the contact form. I confirm availability and, if needed, send additional photographs taken in natural light. Shipping is calculated individually based on your address and the dimensions of the work — I provide the exact cost in writing before you confirm your order. Once payment is received, I pack the work and ship it.

1. Seller

2. Scope and Application
These General Terms and Conditions of Sale govern all purchase transactions between the seller Eugen Varzić (hereinafter: Seller) and the buyer (hereinafter: Buyer) conducted through the website eugenvarzic.com.
By placing an order, the Buyer declares that they have read, understood, and accepted these Terms in full. The Terms are permanently available on this page and apply to all transactions concluded via the website, by email, or by any other written means.
3. Products
All works offered for sale are original, handmade, and unique artworks, unless explicitly stated otherwise. Each work is described by medium, dimensions, year of creation, and availability. Photographs are taken in natural or studio light and faithfully represent the work; however, colours may vary slightly depending on the Buyer’s screen calibration. The Buyer may request additional photographs before confirming an order.
4. Ordering and Formation of Contract
Orders are placed by contacting the Seller via the contact form or by email. A contract of sale is considered concluded only after the Seller has confirmed the order in writing and the Buyer has made payment in full (or paid the agreed deposit). The Seller reserves the right to decline any order without being required to provide a reason.
5. Prices
All prices are stated in EUR. The Seller is not registered for VAT and therefore does not charge VAT; should the Seller become a VAT payer, prices will be updated accordingly. Prices are binding at the time of order confirmation and apply to that specific order. The Seller reserves the right to change prices for future orders without prior notice.
6. Shipping and Delivery Costs
Shipping costs are not included in the listed price of any work. The shipping cost is calculated individually for each order based on:
— the delivery address (country, postal code) — the dimensions and weight of the packaged work — the chosen delivery service
The final shipping cost is communicated to the Buyer in writing before the order is confirmed. The Buyer is not obligated to confirm the order if they do not accept the quoted shipping cost — in that case, no obligation or charge arises.
Estimated delivery times are: within Croatia 2–5 business days, within the EU 3–10 business days, and for all other countries 7–21 business days from the date of dispatch. These are estimates and may vary due to circumstances beyond the Seller’s control. The Seller is not liable for delays caused by the delivery service, force majeure, or customs procedures.
The Buyer is responsible for any customs duties, import taxes, or other charges imposed by the authorities of their country.
7. Payment
Accepted payment methods will be specified in the order confirmation (bank transfer, PayPal, or other available options). Full payment is due before the work is dispatched. For commissioned works, a deposit of 50% may be agreed upon at the time of order confirmation, with the remainder due before dispatch.
8. Right of Withdrawal
In accordance with the Croatian Consumer Protection Act (Official Gazette 19/22) and EU Directive 2011/83/EU, a consumer — a natural person purchasing outside the scope of their professional or business activity — has the right to withdraw from the contract within 14 days of receiving the goods, without providing a reason.
The right of withdrawal does not apply to:
— works created according to the Buyer’s specific requirements or personalised orders (commissioned paintings, portraits from photographs, etc.) — works that have been clearly customised for the Buyer and cannot be resold as new
To exercise the right of withdrawal, the Buyer must send the Seller a clear written notice of withdrawal (by email) within 14 days of receiving the goods. The Buyer bears the cost of return shipping. The work must be returned in its original condition and packaging, with no signs of use or damage. Upon receipt of the returned work in satisfactory condition, the Seller will issue a full refund of the purchase price within 14 days, using the same payment method as the original transaction.
9. Damage During Delivery
If a work arrives visibly damaged, the Buyer is required to:
— document the damage to the packaging and the work with photographs — notify the Seller by email within 48 hours of receipt — retain the original packaging until the matter is resolved
The Seller will cooperate with the Buyer and the delivery service to establish liability and resolve the case (replacement, repair, or refund, depending on the circumstances).
10. Certificate of Authenticity
Every original work is accompanied by a certificate of authenticity signed by the Seller, containing: the title of the work, year of creation, medium, and dimensions. The certificate is an integral part of the delivery and confirms the uniqueness and provenance of the work.
11. Intellectual Property and Copyright
The purchase of a work transfers physical ownership of the original only. All copyright and related rights — including the right of reproduction, distribution, public display, adaptation, and placing copies into circulation — remain exclusively with Eugen Varzić, in accordance with the Croatian Copyright and Related Rights Act (Official Gazette 111/21).
Reproduction, printing, digital publication, commercial use, or the creation of derivative works based on purchased artworks is not permitted without prior written consent from the Seller.
12. Personal Data Protection
The Seller collects and processes the Buyer’s personal data (name, address, email, phone number) solely for the purpose of fulfilling the order and complying with legal obligations. Data is not shared with third parties except with delivery services to the extent necessary for organising shipment. The Seller processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Croatian legislation. Further information is available in the Privacy Policy on eugenvarzic.com.
13. Governing Law and Jurisdiction
These Terms are governed by the law of the Republic of Croatia. In the event of a dispute, the parties will first seek an amicable resolution. If this is not possible, the competent court in Poreč shall have jurisdiction.

14. Amendments
The Seller reserves the right to amend these Terms. Updated Terms will be published on this page with the date of the revision and will apply to all orders received after publication.
